Terms and Conditions and Waiver for Liability for BirdLife Cyprus Bird Tours

Effective Date: 16 January 2025

1. Introduction

These Terms and Conditions and Waiver for Liability (“Agreement” and the “Terms”) govern your participation in bird tours provided by BirdLife Cyprus (ΠΤΗΝΟΛΟΓΙΚΟΣ ΣΥΝΔΕΣΜΟΣ ΚΥΠΡΟΥ) (“BirdLife Cyprus”, “We”, “Us”, “Our/our”). By booking and participating in our tours, you confirm:

  • You have read and understand the Terms and have authority to and agree to be bound by them;
  • You consent to the use of your personal data in accordance with our Privacy Policy and you are authorised on behalf of all persons named in the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);
  • You are over 18 years of age and where placing an order for services with age restrictions you declare that you and all members of the party are of the appropriate age to purchase those services;
  • You accept financial responsibility for payment of the booking on behalf of all persons detailed on the booking.

Should you have any concerns or questions, you must contact us prior to making a booking at info@birdlifecyprus.org.cy. If you are not the sole participant in the tour you booked, you must ensure all your co-travellers are aware of the terms of the “Agreement”.

2. Definitions

  • “Tour”: Refers to the birdwatching experiences we provide, including guided activities and related services.
  • “Force Majeure”: Circumstances beyond our control as described in Section 10.

3. Tour Services and Details

3.1 Tour Type

  • Customized birdwatching tours for 1-4 participants
  • Duration: 1-3 days
  • All clear profits go towards BirdLife Cyprus conservation purposes.
  • The prices of our trips are inclusive of 19% VAT.

3.2 Daily Operations

  • Up to 8 hours of touring per day
  • Maximum 150 km daily travel (including transfers)
  • For multi-day tours, kilometers averaged over tour duration

3.3 Included Services

  • Guided birdwatching in Republic of Cyprus and Sovereign Base Areas
  • Transportation (including pick-up and drop off at accommodation)
  • English-speaking bird guide
  • Tour coordination
  • Entrance fees to any sites

3.4 Excluded Services

  • International flights
  • Accommodation
  • Airport transfers
  • Personal expenses
  • Tips
  • Meals
  • Equipment hire
  • Travel insurance

3.5 Pick-up and Drop-off

  • Included if within 20km of main towns (Nicosia, Limassol, Larnaca, Paphos, Paralimni)
  • €50 surcharge beyond 20km
  • €20 per 30-minute waiting charge

4. Booking and Payment

  • All bookings must be paid for online, through our website, using a credit card or PayPal.
  • Full payment is required at the time of booking to confirm your participation.
  • A legally binding contract is formed once payment is received in full and a confirmation email is issued. These Terms, the Terms and Conditions on our website, Our Privacy Policy and any written communication made by Us to you prior to issuing the confirmation of the booking form part of the binding agreement between Us and you.

5. Cancellation Policy

By You:

  • Cancellation within 48 hours of booking: Full refund.
  • Cancellation up to 60 days prior to the tour start date: Full refund.
  • Cancellation 60-30 days prior to the tour start date: 50% refund.
  • Cancellation 29-0 days prior to the tour start date: No refund.

All cancellations must be submitted in writing to info@birdlifecyprus.org.cy. Refunds will be processed within 30 days of receiving the cancellation request.

If your cancellation falls under the terms of your travel insurance, you may be able to recover these charges from your insurer.

By Us:

We reserve the right to cancel or amend tours due to unforeseen circumstances, including but not limited to insufficient bookings, adverse weather conditions, or Force Majeure events. If we cancel a tour:

  • We will notify you promptly.
  • You will be offered an alternative tour or a full refund.
  • We are not responsible for any additional costs you incur, such as non-refundable flights or other arrangements.

6. Liability and Insurance

Limitation of Liability:

To the fullest extent permitted by law:

  • We are not liable for any personal injury, illness, death, loss, damage, or additional expenses arising from your participation in the tour, except where directly caused by our negligence.
  • Personal belongings are your sole responsibility during the tour. We are not liable for loss, theft, or damage to your property.
  • It is your responsibility to ensure you are physically and mentally fit to participate in the tour.

Insurance:

We strongly recommend obtaining comprehensive travel insurance that covers cancellations, medical emergencies, personal liability, and loss of personal property. By booking a tour, you acknowledge that failure to procure such insurance is at your own risk and BirdLife Cyprus will not be liable for any losses howsoever arising, in respect of which insurance cover would otherwise have been available.


7. Participant Requirements

  • Participants must be 12 years or older. Minors must be accompanied by a parent or guardian who assumes full responsibility for their safety and conduct.
  • You must disclose any medical conditions, allergies, or restrictions at the time of booking. Failure to disclose relevant information may result in denial of participation without a refund.

8. Code of Conduct

To ensure a safe and enjoyable experience for all:

  • Follow all instructions provided by our guides and staff.
  • Show respect for fellow participants, local communities, and wildlife.
  • Refrain from disruptive, abusive, or illegal behavior.

We reserve the right to remove any participant from the tour if their behavior compromises the safety, enjoyment, or integrity of the experience. No refunds will be issued in such cases, and any additional costs incurred due to removal will be the participant’s responsibility.


9. Special Requests

  • We do not guarantee that we will be able to accommodate special requests relating to dietary restrictions, medical needs, or other special requirements.
  • Participants are responsible for managing their personal needs, including medications and specialized equipment.

10. Changes to Tours

  • While we endeavor to adhere to published itineraries, adjustments may be required due to weather, safety concerns, or availability of services, unforeseeable natural elements.
  • We reserve the right to make such changes without prior notice. When possible, we will provide comparable alternatives.

11. Prices

We reserve the right to vary our prices as quoted. Variations may be due to but are not limited to cost changes and changes of prices in our contracts with third parties such as transport providers.

12. Force Majeure

We are not liable for failure to perform or deliver services due to events beyond our reasonable control, or beyond the control of our suppliers/contractors, the consequences of which could not have been avoided even if all reasonable measures had been taken, including but not limited to:

  • Natural disasters (e.g., earthquakes, floods, severe weather).
  • Pandemics, epidemics, or public health emergencies.

Civil unrest, warfare, acts of terrorism, or government restrictions. In such cases, we may but are not obliged, issue credits for future tours instead of refunds. We will not be responsible for additional costs incurred by participants (e.g., non-refundable travel arrangements).


12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of Cyprus. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Cyprus. Parties are encouraged to resolve disputes amicably through mediation before pursuing legal action.


13. Privacy

  1. We are committed to protecting your personal data. Your information will be collected, used, and stored in accordance with our Privacy Policy.
  2. By providing us with your email address, you agree to receive all required notices electronically, to that email address. From time to time, we may use this email address to send you notifications about updates and improvements, our news and events, as well as other marketing materials. By providing us with your phone number, you agree to receive messages and/or calls (through WhatsApp for example) by the bird guide for logistical coordination during the tour’s duration.
  3. Occasionally, BirdLife Cyprus will make use of photographs and/or video which was taken during the trip, either by professional photographers, staff or fellow travellers, for social media, print and other promotional purposes. If you prefer that your image is not used in this way, please let us know. If you did not notify us and subsequently noticed a photo of yourself, please notify us. When/where possible, the photo will be removed.

By booking and participating in our tours, you acknowledge that you have read, understood, and agreed to these Terms. These terms form a legally binding agreement between you and BirdLife Cyprus.
